Terms of Use

1. Acceptance

These Terms of Use govern your use of the DigiCFO mobile application provided by Abyay Banerjee. By downloading or using DigiCFO, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.

2. Purpose of DigiCFO

DigiCFO is a personal financial record-keeping, analysis, and planning tool. It helps users organise information they provide and view calculations or projections derived from that information.

3. Not financial, investment, tax, legal, or accounting advice

DigiCFO provides general information and software-generated calculations. It does not provide professional financial, investment, tax, legal, accounting, credit, lending, or insurance advice. Outputs are not recommendations or guarantees.

You remain responsible for verifying information and obtaining qualified professional advice before making a financial or legal decision.

4. Your information and backups

You are responsible for the accuracy and completeness of information entered into DigiCFO. Financial records are stored locally on your device. You are responsible for device security and for creating, protecting, and testing backups.

Deleting the app, resetting a device, losing a device, or installing the app on another device may result in loss of local information. An App Store download, purchase, or subscription does not itself transfer your DigiCFO financial records.

5. Licence and acceptable use

Subject to these Terms and applicable marketplace rules, you receive a personal, limited, non-exclusive, non-transferable, revocable licence to use DigiCFO.

You must not:

• use the app unlawfully or to violate another person's rights;
• attempt to defeat security, purchase verification, or access controls;
• reverse engineer, redistribute, resell, or commercially exploit the app except where applicable law expressly permits;
• introduce malicious code or interfere with the app's operation.

6. Purchases and subscriptions

If DigiCFO offers paid features, purchases and subscriptions made through the App Store are billed and administered by Apple under the terms displayed at purchase. Subscriptions renew automatically unless cancelled through the user's Apple Account settings before renewal.

Prices, trial periods, renewal terms, available features, and refund handling are shown through the applicable store and may vary by region. Restoring a purchase requires the Apple Account that originally completed it.

7. Calculations, projections, and availability

Calculations depend on the information, assumptions, dates, and values entered by the user. They may be incomplete, delayed, or inaccurate. Past results and projections do not guarantee future outcomes.

Features may be corrected, improved, replaced, or discontinued. The app may occasionally be unavailable because of maintenance, device limitations, operating-system changes, or circumstances outside the developer's control.

8. Intellectual property

DigiCFO, including its software, design, branding, and original content, is owned by Abyay Banerjee or used under licence and is protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

9. Disclaimer of warranties

To the maximum extent permitted by law, DigiCFO is provided “as is” and “as available,” without warranties of uninterrupted operation, error-free calculations, fitness for a particular purpose, merchantability, non-infringement, or preservation of local data.

10. Limitation of liability

To the maximum extent permitted by law, Abyay Banerjee will not be liable for indirect, incidental, special, consequential, or punitive loss; lost profits or opportunities; financial decisions; or loss of information arising from use of, or inability to use, DigiCFO.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limits rights available under mandatory consumer-protection law.

11. Suspension and termination

You may stop using DigiCFO at any time. Access may be suspended or terminated if you materially violate these Terms, compromise the app's security, or misuse paid features. Sections intended to survive termination will continue to apply.

12. Governing law

These Terms are governed by the laws of India, without prejudice to mandatory consumer rights that apply in your place of residence. Courts with lawful jurisdiction may hear disputes that cannot be resolved informally.

13. Changes to these Terms

These Terms may be updated to reflect changes in DigiCFO, marketplace requirements, or applicable law. The effective date will be revised, and material changes will be communicated where appropriate. Continued use after an update constitutes acceptance to the extent permitted by law.
